1. General provisions, application of the general terms and conditions of sale

1.1 These general terms and conditions of sale are applicable to orders placed on the website canonica.com. The customer who completes and confirms the purchase order on this website (www.canonica.com), accepts these general terms and conditions of sale of Canonica, chemin des Batailles 18, 1214 Vernier, Switzerland. These general terms and conditions are applicable to the following contract.
1.2 No special condition or other conditions of the customer may prevail over these conditions, without the express agreement of Canonica SA.

2. Placing orders and confirmation

2.1 The presentation of products on the online store does not constitute a contractual obligation. It is an invitation to place an order.
2.2 By confirming his order, the customer places a firm order for the products in his basket. The customer no longer has the possibility to change it.
2.3 The customer undertakes to correctly fill in all the necessary data concerning him such as his name, recipient’s address, payment details. In the event of an error in the recipient’s contact details, Canonica SA cannot be held liable for for the impossibility to deliver to the recipient.
2.4 Each order of products is subject to acceptance by Canonica SA which reserves the right to reject any order due to insufficient stock, incomplete customer information or any other legal reason. Canonica SA undertakes to confirm the order by email within two working days.

3. Prices and payments

3.1 The prices of the products are net and inclusive of VAT and are in Swiss francs (CHF). Shipping costs (transport) are subject to an additional charge. These vary according to the place of delivery, the weight and volume of the package.
3.2 The payment of products ordered online is done only by the following credit cards: MASTERCARD, VISA, AMERICAN EXPRESS, DINERS CLUB, EDC/MAESTRO, POSTCARD, POSTEFINANCE, online via the Internet. The validation of the credit card payment is immediate. Only products validated by payment will be sent.

4. Delivery terms, transport, deadlines

4.1 Deliveries are made only in Switzerland. Orders indicating a postal box address can not be taken into account.
4.2 The packages are prepared and packaged by Canonica SA in closed, resistant packaging adapted to the contents and transport requirements.
4.3 Canonica SA undertakes to ship the products ordered by the customer as soon as possible using a high quality carrier.
4.4 No compensation may be claimed in the event of any delay in delivery. Canonica SA cannot be held responsible for any damage that may occur to products due to the opening of the package during its delivery, nor in the event of the recipient’s absence at the time of delivery of the package. The products are manufactured using traditional methods by Canonica SA in Geneva, Switzerland. The relevant declarations are in accordance with Swiss law.
4.5 The delivery times indicated on the website are indicative. The customer is informed that longer delivery times during special occasions and holidays (e.g. Valentine’s Day, Easter, Mother’s Day and Christmas) are to be expected. Orders should be planned accordingly.

5. Products containing alcohol

The sale of products containing alcohol (wines, spirits, sparkling wine, etc.) to persons under the age of 18 is prohibited in Switzerland. By placing an order on the website www.canonica.com, the customer acknowledges these requirements and confirms that he is authorised to make with the purchase.

6. Claims

6.1 Upon reception of the products, the customer must ensure that the delivery is in conformity with his order.
6.2 Any claim must be sent within a maximum of 48 hours after receipt of the package, to Canonica SA, chemin des Batailles 18, 1214 Vernier by registered letter with acknowledgement of receipt. After this period, no claim will be taken into account. The claim must be justified, detailed and mention the article(s) concerned with their respective batch numbers in order to facilitate its processing.
6.3 Canonica SA reserves the right to request supporting documents such as photos, bill of lading.

7. Force majeure

Canonica SA is not liable for non-performance of the contract for reasons beyond its control, such as strikes, terrorist acts, wars, natural disasters, problems affecting suppliers and transport.  Each party shall be entitled to an additional reasonable period of time to perform depending on the circumstances.

8. Warranties

The minimum shelf life date is indicated on each package. Canonica SA guarantees the quality and freshness of its products subject to compliance with the storage instructions mentioned on the packaging and labelling.

9. Data protection

Personal data obtained by Canonica SA from the customer is stored and processed in accordance with the legislation applicable in Switzerland.

10. Applicable law / Severability / Amendments / Place of jurisdiction

10.1 These general terms and conditions of sale are governed exclusively by Swiss law.
10.2 If any part of these general terms and conditions of sale is declared void by a court of law, this does not affect the validity of the remaining provisions of these general terms and conditions of sale.  They may be modified at any time by Canonica SA.
10.3 The Geneva courts have jurisdiction over any dispute or disagreement concerning these general terms and conditions of sale, subject to appeal to the Federal Court.
